The BPA's 'Master Plan' for Parking 2011-12!!

This Master Plan is all for furthering their aims to increase enforcement and penalty charges.

And they want to do away with public consultation for simple things, racking up the charges are the simple things they are talking about, these twats want to just dictate.

Yeah right what a complete load of Bull Sh*t in every case you would care to look at the Local Authority is making millions of Pounds out of PCN,s . And in every case they are using PCNs to fill black holes in their budgets.


It seems to me the BPA are a bunch of self appointed self serving shysters .



Life should NOT be a journey to the grave with the intention of arriving safely in an attractive and well-preserved body, but rather to skid in sideways - Beer in one hand - chocolate in the other - body thoroughly used up,  totally worn out and screaming "WOO-HOO, what a  ride!!"

Well, since we already know that Councils (WCC is the example that springs to mind) routinely ignore and/or manipulate public 'consultations' anyway, this is (IMHO) largely irrelevant.  :idea:
The one about making assaults on CEOs/PAs on par with assaulting the Police is a bit of a laugh as a lot of Courts view assault on Police as being part of (the Police's) job.
Apart from those two items, this actually appears to be quite a sensible document.

As far as I'm aware, the BPA 'govern' Parking Enforcement on private land.
Since any so called PCN issued on private land is (in Law) an Invoice, and therefore subject to  Contract Law - i.e it's a Civil Offence - and can only be enforced in the County Courts and then only if they (the Parking Company) can show that:
1. You, the registered keeper, agreed to the Contract - how can you, you may not have been the driver?
2. The Contract is 'fair' - how can it be if you weren't given the chance to see it first?
3. There is a 'loss' - if you park in (for example) Tesco's free Car Park for over the time allowed the 'loss' is zero.
4. The amount they are claiming is equal to the 'loss' - if you  park in Tesco's Car Park which costs £1 per hour, you pay £1 (for an hour) but stay for 2 hours then their 'loss' is £1. Set that against the cost of taking someone to Court and it's a no win situation.
This is why Private Parking Company's never actually do anything on the rare occassion that someone refuses to pay their 'fine' - it's totally enenforceable and would be laughed out of Court - they rely on people being ignorant of the Law, which is also why they are panicking over not being able to clamp on private land anymore - it takes away their only 'weapon'.

A brief look at the BPA website will confirm that they are indeed involved with the Local Authorities in fact if you look at the list of BPA,s own Council listed here you will find a few mentioned.

I would never presume or assume where Local Authorities are involved, if nothing else my days with the NoToMob has taught me that they are never ever to be trusted with doing the right thing unless it earns them more money.
