Hammersmith & Fulham Bus Lane CCTV - 1 year = >£674,000?

Hi all,
Long time, no see etc.   and oh how I've missed you.

I thought I'd share something with you that I just found while searching for evidence to form part of my appeal against a riding in a bus lane PCN.

I got nabbed riding in the offside bus lane on Shepherds Bush Road (http://g.co/maps/8b96s - there).  I appealled, they rejected.   I now have the NTO so will appeal officially.   While investigating, I came across this little FOI gem on their site:

Note the answer to question 2.   The number of PCNs issued has grown and grown over the past 4 years resulting in 5,619 issued 25/10/2010 to 25/10/2011.   If each PCN was paid at £120, that would equal £674,280. In just one year.

Not bad.

Without referring to Pepipoo & just looking at the way the lane is marked on Google street view they don't have a leg to stand on. Assuming that the markings are the same it's a Slam Dunk on Appeal ! Therefore the £674,000 of refunds ought to be forthcoming as well.

The FoI reply says that they got DfT approval for the road layout. Why take their word for it? Why not FoI them for sight of all correspondence between the council and DfT regarding the layout?

If the google street view is still accurate

There is no Diagram 959 "Start of bus lane" sign.

There are no 'deflection arrows'

Those should be good grounds for PaTAS

Thanks to BGB for pointing out the incorrect signage and road markings. I am sure that they did not get DfT approval for these inconsistencies.

I think that an FoI to the DfT asking for copies of all exchanges between the LBHF and the Dept (including any records of telephone conversations) in respect of the bus lane might be revealing. Whilst you might simply get the same information there could be some important differences worth examining.

See the attached extracts from the DfT Traffic Signs Manual which sets out clear guidance for the signs and markings to be used to implement a bus lane.

I've now visited this lane and I feel that it is worthy of some NTM attention.

The Diagram 958 is behind the bus stop where it cannot be seen by traffic when there is a bus stopped.  Of course it is not uncommon for a bus to stop at a bus stop.

The Diagram 958 sign is also after the start of the dashed lines for the bus lane when it should be before.

The Diagram 959 sign is missing.

Also, traffic approaching the junction intending to exit the traffic system in a westerly direction will normally expect to enter the system in the offside lane.  It is certainly unusual to expect traffic wishing to go 'right' at the junction to pull to the left lane which has been a bus lane in order to turn right.

I had noticed that there was no 959 sign and also that the 958 sign was behind the dashed lines. I had not realised that the sign could be obscured by a bus parking in the bus stop. 

This whole arrangement seems to have been set up as a honey trap. More revenue generation at the expense of any attempt at gaining any compliance.

Looks like a standard rejection letter. A failed attempt at defending the indefensible.

There are also likely to be fatal defects to their 'evidence'. PM me your number and I will discuss.
