A possible case regarding alleged poor signage. If the NTM can offer valid advice on the regulations that helps him, there might be some PR benefit...

I think it's only at train station car parks, I'll have a look.

edit: Its in any car parks controlled by the council. Thankfully, the government chose not to leave the power in the hands of those likely to abuse it.

This sign is on a Hackney council housing estate.

99% of Council housing estates are private land for the purposes of enforcement.

Clamping and towing away on private land is outlawed by S54 of the PoFA 2012.

http://www.legislation.gov.uk/ukpga/2012/9/section/54/enacted

Therefore Hackney council (nor any other council) can authorise clamping and towing away on their own land even though they may retain the right to do so on public roads within their borough.

In this case, if Hackney were to clamp or tow away a vehicle pursuant to the sign KS has posted up, whoever gave that authority to the contractors would be guilty of a criminal offence.

Hmm interesting. I have found something that questions whether Hackney's clamping here was ever legal (post '04 at least)

TMA 2004

79

(6) The regulations shall also provide that an immobilisation device must not be fixed to a vehicle in a parking place in respect of a contravention consisting of, or arising out of, a failure—
(a)to pay a parking charge with respect to the vehicle,
(b)properly to display a ticket or parking device, or
(c)to remove the vehicle from the parking space by the end of a period for which the appropriate charge was paid,until 15 minutes have elapsed since the giving of a notification of a penalty charge in respect of the contravention.

6 a & b specifically.
