Motorist James overturns £60 parking fine - by proving he was two miles away

MOTORIST James Cooper has had his parking fine overturned – after proving he was working out at a gym when his car was supposedly parked two miles away on a supermarket car park.

The 26-year-old was hit with the £60 fine after being accused of overstaying the 90-minute limit on the free car park in Newcastle.

But James was adamant he had only parked at the CCTV-monitored Lidl car park in Lower Street for 70 minutes after going there from the gym.

He appealed against the fine and, armed with proof of his whereabouts from M Club, in Trent Vale, has managed to overturn the penalty.

Now the marketing officer fears dozens of motorists are wrongly being handed parking fines on CCTV-operated free car parks.

He said: "I'm outraged. If this has happened to me it has probably happened to countless other people."

James was accused by national firm UKPC of parking at Lidl from 2.10pm to 4.12pm.

James, of Newcastle, said: "I got to the Lidl car park at 3.20pm – I know the time because I was meeting a friend at 3.30pm. I was there until about 4.30pm and when I returned there was a parking ticket on my car, which shocked me. I immediately went home and logged on to the UKPC website where you can view photo evidence from the parking attendant.

"There were five photos of my car – four from 4.12pm, but the fifth was time-stamped 2.10pm.

"I knew I hadn't been there at that time because I was at the gym. I hadn't been to the car park earlier that day either."

James lodged an appeal against the charge – and was told the fine would not be overturned. But James was determined to be proved right and contacted the M Club which confirmed he was at the gym at 2.11pm.

He added: "The gym gave me a print out from the computer which showed I booked into the gym at 2.11pm. I knew this didn't prove my car was there at that time, but I got a copy of my car insurance that shows I am the only person insured to drive my car, to show no one else could have parked it at the Lidl car park."

M Club assistant general manager Debbie Evans said: "Mr Cooper approached us about proving he was at the gym at the time. We were able to give him evidence of what time he had swiped in at our premises."

James was finally told his fine had been quashed after sending the new evidence to the company.

His girlfriend, Jenny Podmore, aged 30, who lives with James, said: "I was disgusted and couldn't believe it had happened. The same thing could have happened to other people who might have paid their fine without realising the discrepancies in the times."

The firm's email to James said: "We understand your frustration and appreciate the inconvenience this has caused you. It is not our intention to cause undue worry and frustration when enforcing our clients' parking regulations. We have investigated the appeal based on the information submitted by yourself and can confirm in this instance the parking charge has been cancelled."

James has complained to the British Parking Association. It has the power to bar companies which persistently break its rules from the association.

A spokesman said: "We are investigating the matter after Mr Cooper contacted us. UKPC has 14 days to respond to us."

Unless Mr Cooper has set up one of the biggest cons in history in order to avoid paying the half rate of £30, the only way this could have happened is for the wea$el to adjust the time on his digital camera to 2.10pm, take the first photo and then change the time back to 4.12pm to take the other four photos.

Pursuant to Section 2 of the Fraud Act 2006, that is called fraud by false representation and is a criminal offence.

If I was Mr Cooper I would seriously consider popping round to my local nick.

More motorists speak out against parking tickets at Lincoln car park


Matt Treacy was issued with a parking ticket on August 22 at the Tritton Retail Park

Fuming motorists in Lincoln have described their anger at receiving parking charges from a city centre retail car park, which they claim are unjustified.

As previously reported, Lincoln driver Simone Riley-Young has requested the cancellation of a ticket issued to her by private company UK Parking Control (UKPC) after claiming that she was in bed when she supposedly drove into the Tritton Retail Park in July.

Since then, The Lincolnite has received a number of reports of similar charges at the same car park.

Leading the complaints is 27-year-old Matt Treacy, who runs a computer repair and web design business in the city.

Matt said that he arrived at the Tritton Retail Park at approximately 3.15pm on Saturday, August 22, parking in a space adjacent to the one in which Simone received a ticket a month earlier.

When he returned to his car, he found a ticket, time-stamped with 4.18pm. The charge said that Matt arrived at the car park at 2.06pm, something he argues was impossible.





He said: “I have four independent sources to show the vehicle’s whereabouts that prove it could not possibly have been in the car park at 2:06pm.

“I’m incredibly annoyed. The photographs clearly are taken moments apart, the vehicle to my right was there in two pictures taken hours apart, then disappeared instantly in the next.”

Matt has appealed to various organisations such as the Citizens Advice Bureau, Trading Standards, Parking on Private Land Appeals (POPLA) and the British Parking Association, all without success.

He now intends to acquire CCTV evidence for his defence and report the alleged crime to Lincolnshire Police.

He added: “I also intend to wait for the parking warden to arrive at some point so I can see what he’s using to take his evidence.

“I will be purchasing a time locked 360 recording dash cam in the near future to record incidents like this.

“I will also be writing and providing evidence to all the retail outlets and the company that owns this entire retail park to insist they push UKPC out of their car park.

“I now make it my goal to always park in the exact same place when I visit that car park.

Matt is currently awaiting a response from UKPC to his appeal.

He has also set up a Facebook group, and is encouraging other Lincoln motorists to share their experiences.



A husband and wife couple, who wish to remain anonymous, also claim to have experienced the same problems at the car park on Sunday, August 23.

The two say they left their house at just after 12.30pm, parking outside HomeSense in the car park.

The couple walked to the Brayford to look at the 1940s event with their baby boy, returning to their car at 2.30pm to find that it had also been ticketed.





They said: “We returned to the car at 2.30pm to find a ticket, stating it had first been seen there at 12.05pm. We hadn’t even left the house then!

“In the photos, the shadow at the bumper is in the same place on both, and the two cars parked either side are the same cars in both.

“We appealed immediately, and received an email confirming they had received it, but have heard nothing since.”

UKPC have been contacted by The Lincolnite regarding both cases, but have failed to respond.
