shepherds bush road, entered a bus lane
« on: 31 August, 2018, 11:04:26 AM »
Hi i got a ticket for driving on shepherds bush road and entered a bus lane. A quick search on google suggest many drivers have been caught out by this. What should i do?

Is this the one at the junction with the Hammersmith Gyratory, where the bus lane switches from nearside to offside?

It is the same one. I know it does not make it ok, but i have driven on this junction manytimes before and have seen so many drivers go on this bus lane. I did this only once, on this day, and got caught. The bus lane is only for a very short duration, so on the day i made the offence about 4 people before me would have also been caught by this camera in a space of less than a minute.

The problem with this bus lane, is that it appears suddenly to your right and it is only in place for few meters.  If you follow the Highway Code it says to move to the far right if you are coming off a roundabout on the third or more exit. My journey on the day was that i was going onto the Great West Road.

The signage is inadequate - London Tribunals Case No. 2130001786.
Write to the Council along the lines of:-
"Dear Sirs,
PCN No. xxxxx.
Contravention did not Occur
I refer you to the decision of Mr Adjudicator Sean Stanton-Dunne in London Tribunals Case reference 2130001786 in which he ruled that the signage at the location is inadequate, and that the Bus Lane does not comply with the DfT authorised diagram.
In light of the above, I ask that you cancel this PCN immediately.
Yours Faithfully"

Obviously, put it in your own words - some Council's monitor forums like this

Probably not as much as the Box Junctions on the gyratory itself!
