VCA certs boo boo
« on: 08 May, 2011, 02:50:39 PM »
Oops! Looks like Southwark have 'done a Richmond' in respect of VCA certs.  Have suggested they suspend enforcement . It might be good to have dated pics if they haven't stopped ;-)

The reporter from Southwark news called FPW and I today.   She didn't seem satisfied with Southwark's answer that "Everything is in order with our VCA certs" when questioned about my copied email (see below).
What I need is the VCA certs covering the cameras that are actually installed on your MEV’s, i.e. Bosch MIC 400 Series and Wonwoo. The attached certificate does not cover these cameras. A certificate for the wrong hardware does not mean the current kit is covered! It must specify the correct models. Unless you can provide a certificate with the cameras that are actually being used, it would appear that the MEV’s are being used illegally and recommend immediate suspension of enforcement.

Mr Sole of Southwark tells me there's nothing fishy going on! The VCA back-dated their certificates, that's all  ::) So that's OK then!  ??? This will be the missing cert that magically appeared when we and the press started to ask embarrassing questions?
Thank you for your email. [/font:3e06uduh][/align:3e06uduh] [/align:3e06uduh] In regards to paragraph 1,  the request for a copy of the current VCA certificates meant  the Council checked back through the correspondence file with the VCA.  The last major change to our certification was the inclusion of a different type of CCTV vehicle.  We lodged our technical contraction file (TCF) with the VCA for these new vehicles on 04 July 2010, in response we received an email on 21 July 2010 confirming that they had accepted the change and we were re-certificated and that we could begin using the new vehicles.  [/font:3e06uduh]The VCA did not send on the new certificates at this point but have now issued the two certificates dated 21 July 2010 to which their email of the same date referred.[/font:3e06uduh][/align:3e06uduh] [/align:3e06uduh] In regards to paragraph 2 this has been referred as a new freedom of information request. [/font:3e06uduh][/align:3e06uduh] [/align:3e06uduh] In regards to the quote referred to, it is from the chief adjudicator for the Traffic Penalty Tribunal which covers England and Wales but excludes London hence the reference to Traffic Regulation Orders (TRO's) which do not exist in London.  The Council does not believe that any similar sentiment has been stated by the chief adjudicator for London.[/font:3e06uduh][/align:3e06uduh] [/align:3e06uduh] Our traffic management orders state:[/font:3e06uduh][/align:3e06uduh] [/align:3e06uduh] Extract from: Exceptions and exemptions to our Traffic Management Orders Page 5 of 440[/align:3e06uduh] Excepted Vehicles
8.1 The restrictions imposed by Article 4 of this order shall not apply :-
(e) in relation to a vehicle being used in the service of a local authority in pursuance of statutory powers or duties provided that in all the circumstances it is reasonably necessary in the exercise of such powers or the performance of such duties for the vehicle to wait in the place in which it is waiting;
(h) where notice is given to the Council or authorised agent, their consent is obtained in writing and any such conditions as they may impose are complied with.
The Traffic Management Act 2004 clearly places a statutory duty on local authorities.
The council believes (e)/(h) clearly gives Southwark Council as a local authority the right to let it's or it's contractors vehicles when displaying an 'A' permit (written permission) and carrying out their statutory duties to wait in contravention.

Hey ho! Away we go! FOI time:
Dear Southwark Borough Council,

I would like unredacted copies of emails exchanged between Southwark Council and the VCA regarding the type approval of CCTV enforcement equipment between the following dates:

1) 1st-31st July 2010
2) 1st-18th May 2011

I see Southwark are getting all WCC on me and turning my innocent questions in to FOIs to buy time ::)

Re: Your request for information: 149384

Thank you for your request for information that was received on 16 May 2011 in which you requested:

Obviously, it is pertinent that the correct certification was in place throughout the period of use of each type of equipment. Will you provide me with the dates that mobile enforcement commenced and ceased with each type of equipment or will we have to go through the tiresome process of an FOI?

Your request is being dealt with under the Freedom of Information Act 2000 and you will receive a response within 20 working days of the date that we received your request.

The Freedom of Information Act 2000 defines a number of exemptions that may restrict the release of the requested information. There will be an assessment and if any of the exemptions categories apply then the information may not be released. You will be informed if this is the case, including your rights of appeal.

The information provided will be in English, normal font size. If you require alternative formats, e.g. other language, audio, large print, etc. please notify us.

If we are unable to provide you with the information requested we will notify you of this together with the reason(s) why and details of how you may appeal (if appropriate).
